Welcome to Itheum’s Data DEX! An open and public platform that enables you to have greater control and transferability of your data with anyone by using the blockchain technology. We are committed to protecting your privacy and ensuring that your personal data is handled in accordance with the General Data Protection Regulation (GDPR). The Data DEX service is available for public access at

While we use reasonable attempts to ensure the accuracy and completeness of the content, designs graphics and logos materials on the Website (Our Content), to the extent permitted by law, we do not warrant the accuracy, completeness or suitability of any of Our Content. The Content may be subject to change without notice and we do not undertake to keep the Website up-to-date. Our Content is factual information only, is not comprehensive and is for general information purposes only. We also do not warrant that access to the Website will be uninterrupted, error-free or free from viruses.

The Data DEX comprises of the following sub-services:

  • The:

  • (a) Data NFT Marketplace (Data NFT Marketplace Services)

  • The:

  • (b) Data NFTs; and (c) Minting Platform (collectively, the Data NFT Services)

Both Data NFT Services and Data NFT Marketplace Services are collectively called the “Application”.

This privacy statement (“Privacy Statement”) applies to the treatment of personally identifiable information submitted by, or otherwise obtained from, you in connection with the “Application”.

By using or otherwise accessing the Application, you acknowledge that you accept the practices and policies outlined in this Privacy Statement.

The Application is operated by Soft 4 Chain S.R.L. [company registration number 47742723] (we, our or us).

Definitions

  1. API means an application program interface.

  2. Compatible Networks means the following crypto networks:

    • (a) MultiversX Blockchain network;

    • (b) Astar Network Blockchain network;

    • (c) Ethereum Blockchain network;

    as amended from time to time.

  3. Crypto Wallet means a digital wallet, capable of holding cryptographic digital assets and interacting with a blockchain (eg. Ledger, XPortal, Metamask).

  4. Data NFT is a cryptographic digital asset that is minted on the Compatible Network of blockchain

  5. Website means the website at (and any successor or related website designated by us), as updated by us from time to time.

  6. NFT means a non-fungible cryptographic token that interacts with a blockchain.

  7. Smart Contracts are simply programs stored on a Compatible (blockchain) Networks that run and execute logic when predetermined conditions are met.

1. WHAT PERSONAL INFORMATION DOES THE APPLICATION COLLECT?

We collect the following types of information from our users:

1.1. Personal Information You Provide to Us:

1.2. Personal Information Collected Automatically:

(a) Your Crypto Wallet "type" (e.g. MultiversX Web Wallet, xPortal App etc).

(b) Your Crypto Wallet "public address" (This is the same Crypto Wallet public address will be publicly visible on Compatible Networks) may be collected for analytics use cases from time to time

(c) No other personal information is collected automatically by the Application.

2. HOW DOES THE APPLICATION USE THE INFORMATION IT COLLECTS?

(a) Your Crypto Wallet "type" is used to improve the user experience for the user within the Application, assist with wallet specific user journeys and for analytics use cases from time to time (e.g. to discover how many people use specific types of wallets)

(b) Your Crypto Wallet "public address" (if collected during any campaigns) will be used for analytics use cases from time to time. It may also be used during certain campaigns to anonymously measure usage of the opening of the Data Streams that a user's Data NFTs unlock. It should be noted that we NEVER have any access to the actual data within the Data Steams, but we may from time-t-time measure usage of a user clicking the "View Data" button and link this to their public wallet address.

(c) We will never send any promotional material or messages as we do not collect any contact details.

3. WILL THE APPLICATION SHARE ANY OF THE PERSONAL INFORMATION IT RECEIVES?

We DO NOT rent nor sell your personal information to anyone without your consent. You will be notified when your personal information may be shared with third parties, and you will be able to prevent the sharing of this information.

4. DATA SECURITY

We implement appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage. This includes the use of encryption technologies and secure server infrastructure.

5. WHAT HAPPENS TO A USER’S DATA WHEN AN ACCOUNT IS DELETED?

The Application is decentralized; therefore, a user account cannot be deleted. The user can discontinue usage of the Application by disconnecting their Crypto Wallet from the Application at any time. If the user disconnects their Crypto Wallet, we may still persist in the storage of your Crypto Wallet "public address" in our associated systems. However, it should be noted that Crypto Wallet's "public address" is already public information that's openly visible on the Blockchain and Smart Contract interactions.

6. CONDITIONS OF USE. YOUR RIGHTS.

Under the GDPR, you have the right to access, correct, delete, or restrict the processing of your personal data. To exercise these rights, please contact us.

7. THIRD PARTY APPLICATIONS/WEBSITES.

The Application may permit you to link to other applications or websites. Such third party applications/websites are not under our control, and such links do not constitute an endorsement by us of those other applications/websites or the services offered through them. The privacy and security practices of such third party application/websites linked to the Application are not covered by this Privacy Statement, and we are not responsible for the privacy or security practices or the content of such websites.

8. 3RD PARTY TECHNOLOGY PROVIDERS.

The Application can from time to time use Developer SDKs (Software Development Kits), Programming Tools (Libraries), embedded tools, analytics tools or infrastructure tools built on or provided by 3rd Party Technology Providers. The following are a list of such 3rd party technology the Application may be exposed to.

Such third party Technology Providers and their platforms are not under our control and the privacy and security practices of such third party Technology Providers are not covered by this Privacy Statement, and we are not responsible for the privacy or security practices of the 3rd Party Technology Providers.

9. CAN CHILDREN USE THE APPLICATION?

Our Website and the services available through this Application are not intended for children under the age of 18. We do not knowingly collect personal data from children under 18. If we learn that a child under 18 has provided us with personal data, we will take steps to delete that information. We believe that children of any age should get their parents’ consent before giving out any personal information. We encourage you to participate in your child’s web experience.

10. INTERNATIONAL DATA TRANSFERS

As a global platform, Itheum may transfer your personal data to locations outside of your country of residence. In such cases, we ensure that adequate safeguards are in place to protect your personal data in accordance with this Privacy Policy and applicable laws.

11. LEGAL BASIS FOR PROCESSING

We process your personal data on the following legal bases:

  • Your consent, which you can withdraw at any time.

  • The necessity of the processing for the performance of a contract to which you are a party.

  • Compliance with our legal obligations.

  • Our legitimate interests, except where such interests are overridden by your interests or fundamental rights and freedoms.

12. CHANGES TO THIS PRIVACY STATEMENT.

We may amend this Privacy Statement from time to time. Use of information we collect now is subject to the Privacy Statement in effect at the time such information is used. If we make changes in the way we use personal information, we will notify you by posting an announcement on our Application via an alert. Users are bound by any changes to the Privacy Statement when he or she uses or otherwise accesses the Application after such changes have been first posted.

If you decide to use or otherwise access the Application, your use/access and any possible dispute over privacy is subject to this Privacy Statement and Itheum Data DEX - Terms and Conditions of Use , including limitations on damages, arbitration of disputes, and application of the applicable legal jurisdictions as specified in the aforementioned privacy and terms of use documents.
